The article is focused on the contemporary problems of reforming the penitentiary system of Ukraine by the results of changes in the models of public administration of the penitentiary system of Ukraine, which took place twice in 2016-2017 (May 2016 and September 2017). This research aims at analysis of the Ukrainian prison and probation policy for the last 30 years. This paper is based on evaluation of different data concerning trends of prison and probation population, crime rates in prisons, mortality and suicide rates in prison in the light of funding of the prison and probation system. The paper contains the main conclusion that the Ukrainian prison and probation policy is not a policy in fact. Unfortunately, it is mostly narrowed to eliminating previous formal bureoarctic structures and creating new ones, the feasibility and necessity of which is not properly explained. Пройшли майже п’ять років як в Україні була задекларована та почала впроваджуватися нова пенітенціарна реформа, яка ставила на меті «знести» стару «радянську» «виправно-трудову систему» та замінити її на відкриту для суспільства пенітенціарну систему, побудовану за світовими та європейськими стандартами.

Гадаємо, що існує нагальна потреба провести аналіз результатів такої реформи для ключових акторів (суспільство, потерпілі, ув’язнені та засуджені, пенітенціарна служба, інші елементи системи кримінальної юстиції, інші зацікавлені актори).

Основні напрями реформування

З огляду на стан справ у пенітенціарній системі на сучасному етапі можна визначити наступні напрямки реформування. Вони були актуальними упродовж останніх 4 років, проте водночас можуть бути перевіркою для нової команди МЮ України.
