Вуличні та в’язничні субкультури, сформовані у рамках неформальних ієрархій, та притаманне їм насильство – це об’єктивні елементи сучасних відносин влади, невід’ємна складова відносин влади та водночас продукт поширення дисципліни паноптичного зразку в суспільстві ХХІ століття[1].

Ця стаття присвячена дослідженню одного з аспектів феномену в’язничних банд у США, а саме діяльності білих супремаcистських в’язничних банд.

Актуальність дослідження обумовлена тим, що станом на 2007 рік у США діяло щонайменше 30 тис. банд, які об’єднували понад 800 тис. їхніх членів. Станом на 2009 рік понад 900 тис. членів банд проживали у межах місцевих громад по всій країні, а понад 147 тис. перебували в американських в'язницях. Станом на 2011 рік за різними оцінками 1,4 мільйона членів банд брали участь у злочинній діяльності або принаймні були членами 33 тис. банд.

Coming back to the issue of the “anti-torture criminal code”, we must point out the problem which is a blurring of borders between “torture” and “other forms of ill-treatment”. Also, it is a process of a permanent increase in actions that are considered as “ill-treatment”. Consequently, the process of increasing of an flexible list of “the State’s torture crimes” shapes a structural problem in the following system of coordinates: 1) the obligations according to the ECHR and the ECtHR case law; 2) increasing scope of the CPT standards; 3) limited resources of States for the places of detention.

In the XXI century, informal prison hierarchies are one of the main problems in prison systems across the world. They are a fact recognised by the authorities of almost all states. As a result, prison subcultures become significant and have serious impact even on free society and taxpayers (not to mention the prison system itself, prison staff, prisoners, and their families).

У 2010 році я завершив підготовку монографії «Пенітенціарна система України: історичний розвиток, сучасні проблеми та перспективи реформування», яка згодом була видана за сприяння Державної пенітенціарної служби України, за що я висловлюю глибоку вдячність керівництву та працівникам цієї служби.

Основною метою візиту було повторне вивчення поводження та умов утримання осіб, які перебувають у в'язницях Молдови.

Based on an interdisciplinary approach, the study demonstrated that the issue of prison subcultures and informal prison hierarchies that produce the relevant subcultures is not a monopoly of criminology, sociology or criminal law.
